User Agreement

This User Agreement ("Agreement") is a binding contract between you and NicheOracle ("we," "our," "us") governing your use of our AI-powered research services at nicheoracle.polsia.app. By creating an account or using our services, you agree to these terms.

1. Nature of the Service — Important Disclaimer

Our Oracles are AI research companions trained on publicly available information. Specifically:

• Herbal Oracle: Content about herbs, plants, and traditional medicine is for informational and educational purposes only. It is NOT medical advice. Do not use Oracle responses to diagnose, treat, or prevent any disease or medical condition. Always consult a licensed medical professional, herbalist, or healthcare provider before using herbal remedies, especially if you are pregnant, nursing, taking medications, or have a medical condition.
• Grants Oracle: Information about grants and funding is for general guidance only. It is NOT legal or financial advice. Grant eligibility, requirements, and deadlines change frequently. Always verify information directly with the granting organization before applying or relying on any information for financial decisions. Consult a qualified financial advisor or grant professional for your specific situation.
• Homesteading Oracle: Content about homesteading, off-grid living, food preservation, animal husbandry, and DIY projects is for educational purposes only. Some homesteading activities carry safety risks. It is NOT professional safety advice. Follow applicable regulations, building codes, and safety standards. Consult qualified professionals before undertaking potentially hazardous activities.

2. Release from Liability

By using NicheOracle, you expressly acknowledge and agree that:

• Oracle responses are generated by AI and may contain errors, inaccuracies, or outdated information.
• You will not rely on Oracle content as a substitute for professional advice in any domain.
• NicheOracle, its owners, operators, and affiliates are not liable for any harm, loss, injury, or damages arising from your use of or reliance on Oracle content.
• You use the service at your own risk.

To the maximum extent permitted by applicable law, you hereby release and hold harmless NicheOracle and its affiliates from any and all claims, damages, losses, liabilities, costs, and expenses arising from your use of the service or reliance on any Oracle-generated content.

3. Eligibility

You must be at least 18 years old to use NicheOracle. By creating an account, you represent that you are 18 or older.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

You may not share accounts or use the service on behalf of others without authorization.

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or extract the AI models or underlying systems
• Use automated tools to send messages at volume
• Transmit content that is harmful, illegal, or violates the rights of others

6. Subscriptions, Billing, and Cancellation

Trial: Your $1 trial gives you 7 days of access. After 7 days, if you subscribed to the monthly plan, billing continues at $9/month per Oracle.

Cancellation: You can cancel your subscription at any time from your account menu. Cancellation stops future billing. You retain access until the end of your paid period.

30-Day Money-Back Guarantee: If you are dissatisfied with a subscription within 30 days of any payment, contact us at support@nicheoracle.com and we will issue a full refund, no questions asked.

Refunds: Outside the 30-day guarantee window, refunds are at our discretion. Contact us — we're reasonable people.

7. Intellectual Property

NicheOracle and its content (excluding user-generated messages) are owned by or licensed to us. You may use the service for personal, non-commercial purposes. You may not reproduce, distribute, or commercialize Oracle responses without permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ORACLE RESPONSES ARE ACCURATE OR COMPLETE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NICHEORACLE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

10. Governing Law

This Agreement is governed by the laws of the United States. Disputes will be resolved in binding arbitration rather than in court, except that either party may seek relief in small claims court.

11. Changes to This Agreement

We may update this Agreement. We'll notify you by posting the new version here and updating the effective date. Continued use after changes constitutes acceptance.
